Welcome to Nodeline AI ("Software", "Website", "App"), operated by the Proprietor in India ("we", "us", or "our"). By accessing or using our Software, you ("you" or "your") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please refrain from using the Software.
1. User Responsibility
1.1. API Keys and Credentials
The application allows you to store and manage third-party AI service API keys and credentials locally on your device. You are solely responsible for securing these credentials and for any activities conducted using them.
1.2. Account Security
You are responsible for maintaining the confidentiality of any information or access control used to secure your device and the application. We are not liable for any loss or damage arising from your failure to comply with this security obligation.
1.3. Content and Use
You are solely responsible for all content, including text prompts, data, and files, that you upload, process, or generate using the application. You agree to use the application in compliance with all applicable local, state, national, and international laws and regulations.
2. Third-Party AI Services
2.1. Independent Services
The application facilitates access to independent third-party AI service providers (e.g., OpenAI, Anthropic, Google). We do not control and are not responsible for the privacy practices, content, or terms of these third-party services.
2.2. Service Risk
The use of third-party AI services through our application is entirely at your own risk. We are not liable for any errors, quality issues, or consequences resulting from the output or use of these services.
3. Data Storage
3.1. Local Storage
All conversations, notes, files, and API keys are stored locally on your device. We do not store, process, or transmit your personal data or user-generated content on our servers.
3.2. Data Backup
You are solely responsible for creating and managing backups of your locally stored data. We are not responsible for any data loss, including, but not limited to, device failure or application uninstallation.
4. Disclaimers
4.1. No Warranty
The application is provided "as is" and "as available" without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
4.2. Limitation of Liability
In no event shall we be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the application; (ii) any conduct or content of any third party on the application; or (iii) unauthorized access, use, or alteration of your transmissions or content.
4.3. High-Risk Use
The application is not designed or intended for use in situations where failure or inaccuracy could lead to death, personal injury, or severe physical or environmental damage.
5. Termination
We may terminate or suspend your access to the application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the application will immediately cease.
6. Intellectual Property
The application and its original content, features, and functionality are and will remain the exclusive property of the Proprietor.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
8. Dispute Resolution
Any legal action or proceeding arising out of or related to these Terms shall be instituted exclusively in the courts located in Lucknow, India.
9. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms within the application. By continuing to access or use our application after those revisions become effective, you agree to be bound by the revised terms.
10. Pre-Order Policy
By placing a pre-order for Nodeline AI, you agree to pay the stipulated amount in exchange for a license key, which shall become redeemable and grant access to the product upon its official commercial launch. All pre-order payments are non-refundable. A refund will only be considered, and is not guaranteed, solely in the event that the product, through no fault of the user, fails to ever commercially launch due to unforeseeable circumstances, including, but not limited to, a major technical emergency or an Act of God. By pre-ordering, you acknowledge this policy.
